IUB lodges complaints against ETP’s pipeline proposal
Engineer claims maps were inaccurate to move forward on permitting process
On June 12th, Jeffrey O’Neal, the Utilities and Regulation Engineer of the Iowa Utilities Board, submitted 14 pages of “deficiencies” related to the Bakken Pipeline proposal to the attorney representing Dakota Access, LLC on the proposed Bakken Pipeline.
These complaints came from staff review of the permit application. IUB stated that they must be addressed before the permitting process can advance any further. In large part, the deficiencies concerned:
Maps that were inadequately drawn, and did not clearly indicate which properties were affected so that landowners would be able to identify whether or not the proposal impacts their property.
City limits were not accurate to the 2014 levels documented by Iowa DOT.
A newly constructed highway was not included on the map.
The full boundaries of Big Sioux River Wildlife Management area were not included, in addition to a handful of other wildlife preserves and public hunting areas across the state.
The application wrongly labeled or inaccurately depicted existing pipeline infrastructure across the state.
The application included a copy of the $250,000 bond, when the bond is required before a public hearing can be scheduled.
We’ve heard from members that Dakota Access, LLC and its parent company Energy Transfer Partners (ETP), lie and manipulate Iowans to try to sell this project to our state.
These complaints, coming from the agency that will ultimately decide on whether or not the pipeline gets built, reinforce that the permit should be denied by IUB. If their first draft is this flawed, it’s time to say NO to the proposed Bakken Pipeline!
